Ruta al Sur: consultation before the road
The road is not built without consulting the Inga People.
What we defend
The Santana–Mocoa–Neiva road concession, some 456 kilometres long, is a public-private partnership megaproject. The concession is a public-private partnership: the public party is the National Infrastructure Agency, attached to the Ministry of Transport. Its Functional Unit 7 passes through our territory with two projects that, we maintain, are one and the same: the Villagarzón ring road and the Puerto Umbría crossing. In 2016 the Ministry of the Interior certified that there were no Indigenous communities in those areas; the Albania Reserve maintains that the certification is wrong.
We maintain that Functional Unit 7 is a single project and must have a single consultation: we demand free, prior and informed consultation on the whole unit, with all the ethnic subjects of the territory, before and not after the works. This is our demand; no judge has yet ruled on its integral character.
How it has unfolded
- 2016Certification that there are no Indigenous communities in the sector.
- 20 Oct. 2023At the request of the Asociación de Desarrollo de Negritudes del Corregimiento de Puerto Umbría, the Administrative Court of Nariño, at second instance in a tutela, orders prior consultation with the Indigenous and Afro-Colombian communities of Puerto Umbría.
- 2024The consultation is held with only two subjects: that association and the Cabildo Musu Waira Sacha Nucanchipa, part of the Inga Indigenous Reserve of Nukanchipa Alpa Amukunapa Wasi.
- 2 Sep. 2025The Second Administrative Court of Mocoa declares partial non-compliance for limiting the consultation to two communities and orders a new process with all of them.
- 29 Jun. 2026The Albania Reserve asks the Ministry of the Interior to comply with the ruling.
- 22 Jul. 2026It asks the concessionaire, the National Infrastructure Agency and INVIAS to open the prior consultation.
- 18 Sep. 2026The Directorate of Prior Consultation requests information on the direct impacts of the ring road on four ethnic subjects that still have not been consulted.
The Villagarzón ring road in figures
The whole Inga People of Villagarzón is affected by the bypass road, and prior consultation must be carried out according to protocol with the whole People, except with Musu Waira, which already held its own, and with Cachiacu Andaki, which pursues its process with its own legal representation. By community, according to the own census (cut-off October 7, 2026): Wasipungo 979, San Miguel de la Castellana 600, Calenturas 237, Albania 144, Blasiaku 98, Chaluayaco 79, Saladilloiaco 78, Alparumiyaco 70, Nukanchipa Taita Kausadiru 64 and Atun Taita Ambi Upiadiru 47.
